Terms and Conditions - And Ever Photography
Please read the following terms and conditions carefully before engaging in any services provided by And Ever Photography. By booking a session or utilizing our services, you agree to comply with and be bound by these terms and conditions:
- Copyright and Image Ownership: 1.1 The photographer retains full ownership and copyright of all images produced during the session, including but not limited to digital files, prints, and negatives. 1.2 And Ever Photography reserves the right to use any image produced during the session for promotional purposes, including public advertising or viral online dispersion, without prior consent from the client. 1.3 The client may not alter, reproduce, publish, or use any images provided by And Ever Photography for commercial purposes without obtaining written permission from And Ever Photography.
- Booking and Payment: 2.1 A non-refundable deposit is required to secure the date and time of the session. The remaining balance is due on the day of the session unless otherwise stated during the booking consultation. 2.2 In the event of cancellation by the client, the deposit will not be refunded. 2.3 And Ever Photography reserves the right to cancel or reschedule a session due to unforeseen circumstances. In such cases, reasonable efforts will be made to accommodate the client's schedule or provide a full refund of any payments made.
- Liability and Indemnification: 3.1 And Ever Photography will take reasonable care in the capture, processing, storage, and delivery of images. However, in the event of loss, damage, or failure to deliver images due to unforeseen circumstances, including but not limited to equipment failure, memory card corruption, or acts of nature, And Ever Photography's liability is limited to a refund of the session fee. 3.2 The client agrees to indemnify and hold harmless And Ever Photography and its representatives from any liability, claims, damages, or expenses arising out of or related to the session or use of images, including but not limited to personal injury, property damage, or any other harm caused by the client or any third party.
- Model Release: 4.1 The client grants And Ever Photography the irrevocable and unrestricted right to use and publish images for editorial, trade, advertising, or any other purpose and in any manner or medium. 4.2 If the client prefers not to have their images used for promotional purposes, they must inform And Ever Photography in writing before or during the session.
- Confidentiality: 5.1 And Ever Photography will treat all client information as confidential and will not disclose any personal or sensitive information to third parties without the client's consent unless required by law.
- Governing Law and Jurisdiction: 6.1 These terms and conditions shall be governed by and construed in accordance with the laws of the Republic of Ireland.
- And Ever Photography is committed to storing client images with a third party cloud provider for a period no longer than 12 months from the date of delivery to the client. Any and all attempts will be made to retain longer than this period where possible or achievable.
By booking a session with And Ever Photography, you acknowledge that you have read, understood, and agreed to these terms and conditions.
